General Terms and Conditions
1. Tourist Travel Contract:
1.1. The company name is Amapa Tours GmbH, Haifastr. 22, 40227 Düsseldorf
1.2. With the trip request the customer is sending Amapa Tours GmbH a Tourist Travel Contract. Your reservation for the trip will be official, when you receive our confirmation in written form.
1.3. In your trip confirmation you will find the complete details, descriptions and conditions of your trip.
1.4. All reservation requests must be sent in writing to our E-Mail address: email@example.com
2.1. After you receive your trip confirmation you must make a deposit of 20% of the total price during the next 7 days to guarantee your space.
2.2. The full payment must be made 30 days before the start of this trip (prior the customer arrival). We won’t make reminder calls. Please deposit the outstanding payment on time.
2.3. Reservations made less than 30 days before trip departure require full payment.

3. Final documents:
3.1. Once your full payment is received you will receive within two to three weeks all vouchers for the trip, a day by day itinerary, a hotel address list and tips for your trip as well as Passport and Visa requirements.
4. Services and changes in prices:
4.1. Price changes from the final confirmed services in your Travel Contract are possible. The itineraries shown are subject to changes, including substitution of hotels, activities and routings. If a service is not provided, and Amapa Tours is unable to substitute a service of similar value, Amapa Tours’ liability shall not exceed the actual cost of the services not provided. Amapa Tours does not own or operate any of these suppliers
4.2. Should the cost of services provided by other companies such as Chepe Train or Baja Ferries increase, this extra cost will be passed along to the customer and you will be informed immediately.
4.3. In case that currency rate changes affect the total price of the tour package, Amapa Tours will charge the difference to the customer.
4.4. Amapa Tours GmbH is not liable for any false data (for example false airline or hotels details). The customer is obligated to follow the trip program and to be present at the meeting points agreed upon with the tour leader or the base itinerary. Amapa Tours GmbH will not make refunds for services not taken.
5. Cancellations fees, Change of reservation:
5.1. If you do not purchase Amapa Tours GmbH Travel Protection Plan at time of deposit, cancellations will be charged per person fees listed below. In fairness to others and because of expenses incurred, we cannot make exceptions.
5.2. Percentage per person from the total tour price.
50 or more days prior to start of tour: 10 %
49 – 40 days prior to start of tour: 15 %
39 – 30 days prior to start of tour: 30 %
29 – 20 days prior to start of tour: 40 %
19 – 10 days prior to start of tour: 55 %
09 – 03 days prior to start of tour: 75 %
02 days prior to start of tour or no shows: 95%
5.3. For early cancellations of the tour there are no refunds. Extra costs like Flight ticket costs will be paid directly by the customer.
5.4. Time of cancellation will be when the notice is received in Amapa Tours’ office. Cancellation fees apply even if a person transfers to another tour or start date.
5.5. The customer agrees that there will be no charges generated to Amapa Tours GmbH for other services such as flight ticket costs.
5.6. The customer can send a request to change the name of the participant before the trip starts. The new participant will be obligated to fulfill the trip conditions. Amapa Tours GmbH can refuse this request when the new participant does not fulfill the trip conditions, trip requirements or when an official order exists.
5.7. When the new participant is accepted they agree to cover the total price of the trip and extra charges.
5.8. Change of reservation for another date will be accepted only with the confirmation of Amapa Tours GmbH. The customer will be allowed to transfer his trip from the original date to a substitute date. Amapa Tours GmbH will charge for rebookings according to the above conditions, when those charges occur. For special requests, such as changing the hotel category or the length of the trip, Amapa Tours GmbH will make appropriate handling charges, a minimum 40,- Euro per person.
5.9. In case that during the trip some services are not provided or the trip must be finished ahead of schedule, Amapa Tours will refund only the cost of the services not provided. This only applies if Amapa Tours GmbH receives a refund from the suppliers. The customer has no right of a partial refund in such cases.
6. Customer requirements (obligations), limitation/exclusion von obligations and claims:
6.1. In case that the customer does not receive the documents for the trip in a timely manner, they must immediately inform Amapa Tours GmbH.
6.2. In case of lack of services during the trip the customer must inform immediately the tour guide and Amapa Tours GmbH. The tour guide or the local supplier is not allowed to provide any other services that the customer demands that are not included in the tour program. The tour guide will receive all complaints, which will be forwarded to Amapa Tours GmbH. In case that the complaint is against a tour guide or that any tour guide in the tour program is included, the customer must send all complaints directly to Amapa Tours GmbH.
6.3. In case of lack of services the customer should submit claim requests within 30 days after they have finished their trip. After this time the client cannot make a valid claim requests.
6.4. In case of lack of services or a problem with a service supplier, the customer is obligated to cooperate with the tour guide in order to avoid injury or discomfort to fellow travelers.
7. Cancellation through Amapa Tours GmbH:
7.1. In case that the minimum of passengers assigned for a group won’t be reached, Amapa Tours GmbH can cancel the tour within 15 days prior to start of tour. The customer can take another or the same tour with the equivalent services and price, but a tour lead won’t be included. If a group tour does not reach its minimum numbers we will either offer for you to take your holiday as a private journey (which may involve a supplement), or you will be fully refunded.
7.2. For cancellation penalties before or after the tour program due to other suppliers, Amapa Tours GmbH is not responsible. For example plane tickets, visa or inoculation, etc.
7.3. Amapa Tours GmbH reserves the right to decline, to accept or retain any person as a member of a tour at any time before or during the actual operation of the tour.
8. Cancellation due to act of nature beyond control:
8.1. Amapa Tours GmbH reserves the right to cancel any tour at any time due to act of nature beyond control (natural disaster, war, disturbances)
8.2. In case that during the trip an act of nature beyond control may occur and some services are not provided or the trip must be finished ahead of schedule, Amapa Tours will refund only the cost of the services not provided. This only applies if Amapa Tours GmbH receives a refund from the suppliers. The customer has no right of a partial refund in such cases. In case of extra charges like extra lodging, transfers, flight rebooking will be paid by the customer directly.
8.3. Amapa Tours GmbH and/or its agents are not responsible for any damage, expense or inconvenience caused by late departures, change of schedule, strikes or other conditions.
9. Liability limitations
9.1. The responsibility of Amapa Tours GmbH is strictly limited; tour participant agrees that maximum liquidated damages shall not exceed the tour price.
9.2. Amapa Tours GmbH is only responsible for making arrangements for the tour services offered, including hotels, sightseeing, and transportation (whether by motorcoach, boat, train, airplane or any other means), guides, porterage, and meals from various suppliers.
9.3. The Suppliers are not agents, servants, employees or joint ventures of Amapa Tours GmbH, but are Independent Contractors providing travel services to Amapa Tours GmbH.
9.4. Amapa Tours GmbH is not liable for any damage, including personal injury, accident, personal loss or other expense, from any cause, act or omission by Suppliers or third parties.
9.5. Amapa Tours GmbH is not liable for any wrongful, negligent, or unauthorized acts or omissions of any travel agent or travel agency.
9.6. In the case of a computer or human billing error, Amapa Tours GmbH reserves the right to re-invoice with correct billing.
10.1. Insurance Services are not included in our tour price. We recommend contracting an individual insurance company for coverage of unforeseen events that may occur during the trip.
10.2. Amapa Tours GmbH has an insolvency insurance (R+V Allgemeine Versicherung AG. Raiffeisenplatz 1, 65189 Wiesbaden, Germany). The insolvency insurance and the insurance certificate will be sent with your confirmation.
10.3. Liability insurance subject to conditions: ERV (Europäische Reiseversicherung AG) Rosenheimer Straße 116, 81669 München.
11. Passport, visa and health care:
11.1. For the trip to Mexico you must have a passport that will be valid for a minimum 6 months.
11.2. As tourist in Mexico you will receive a visa valid for 90 days. Upon your arrival you must fill out a tourist card, which will be given to you during your flight, before you arrive to migration point. Please keep the document with the stamp that you will receive from the migrations officer during the entire trip. When you flight out you must show it to the migration officer, otherwise you must pay a fee.
11.3. Please consult with your physician regarding recommended inoculations.
11.4. Amapa Tours GmbH is not responsible for the costs of any medical treatment required during your tour, nor is Amapa Tours GmbH responsible for the quality, or lack thereof, of medical care you may receive while on your tour.
11.5. Amapa Tours GmbH is not responsible for any extra purchases made during the tour.
12. Legal venue:
12.1. Legal proceedings by or against Amapa Tours GmbH may be instituted only in a state or federal court within the city of Düsseldorf Nordrhein-Westfalen, and any claim involved in such proceedings shall be decided in accordance with the laws of the city of Düsseldorf.
12.2. Notification of legal proceedings from Amapa Tours against a customer will be sent to the address provided by the client. If that client lives in a foreign country the legal proceedings will take place in the city of Düsseldorf.
These General Terms and Conditions apply to offering and providing of the Services by Amapa Tours GmbH and can be changed by Amapa Tours GmbH at any time without prior notice, although such changes will not apply to bookings that have already been accepted by our company on behalf of the Supplier(s) concerned.
It is therefore essential that the Customer reads saves and/or prints a copy of the General Terms and Conditions, in order to be aware of the provisions in force.
These General Terms and Conditions come into force on März 2015.
